Schmitt says the driver in the fatal Christmas Eve incident in Stony Point, who allegedly left the scene of the accident, was in the country illegally, and didn’t have a driver’s license, was released without bail thanks to the new criminal justice reform laws. The criminal justice reform laws went into effect Wednesday.

37 year-old Grafton Thomas of Greenwood Lake faces five federal charges of “obstructing the free exercise of religious beliefs by attempting to kill with a dangerous weapon” and each count carries a potential life sentence. His attorney has claimed Thomas suffers from mental illness. He was also reportedly arrested and released last summer in Orange County for allegedly menacing a police officer. The New York Post reported Thomas was once accused of squatting in a Salt Lake City house, the owners of which claimed he participated in “drug activity.”
